The employer is always obliged to ensure to the employee the rendering of work in healthy and safe conditions and must arrange the Health and Safety at Work services (HSW) according to the mandatory legal modalities.
In general economic activities, work-related accidents should be reported, in which a worker, self-employed working in others’ facilities, the third person of the employment relationship, is mortal victim or suffers a serious injury, within twenty-four hours of its occurrence.
However there are sectors of economic activity which are subject to specific legislation.
Thus, they must be reported in the following cases:
- in shipyards, all work accidents resulting in death or serious injury of workers as well as those who take particular gravity in the security perspective, from causing physical injury to the worker, in the shortest time possible and shall not exceed twenty four o'clock;
- in work on board fishing vessels, occupational accidents resulting in death or injury to workers or that regardless of the production of personal injury, evidencing a particularly serious situation for the safety or health of workers, in the shortest time possible ;
- in extractive industries through drilling, outdoors and underground, accidents that result in death or serious injury of workers, or that regardless of production such personal injury, evidencing a particularly serious situation for the safety or health of workers, within twenty-four hours.
Pursuant to art. 20 of Law No. 102/2009, of 10 September (Law on the legal regime for the protection of safety and health at work), as amended by Law No. 42/2012 of 28 August and by Law No. 3 / 2014 of 28 January, the employee shall receive appropriate training in health and safety at work, taking into account the work station and the performance of high risk activities. However, in order for this training to be considered in the calculation of the 35 hours of training provided for in the Labor Code, it must meet the requirements stated therein: raise the issue of training certificate and record it in the individual skills booklet.

Yes. The employer must provide updated information to workers and their representatives about safety and health in the workplace, the labor doctor or the public body responsible for health surveillance of workers on dangerous substances and chemical preparations, work equipment and the materials or raw materials present in the workplace that can cause an attack on the genetic heritage; identification of exposed workers; the results of the risk assessment.
The information should be passed to independent workers and companies that develop, in any capacity, activities simultaneously with their workers at the employer's premises.
a) The AWC as a body responsible for:
- The inspection of working conditions;
- The making of inquiries in case of deadly accident at work or one that evinces a particularly serious situation;
b) The authorities of health and social security – when they consider convenient to have duties to:
- To promote the realization of the occupational disease investigation or other damage to health related to work;
c) Workers' representatives:
- May submit comments to the AWC and other inspection entities during his visit to the establishment of the company;
- Can request the intervention of AWC in the company.
