Yes, your request to family reunification may be denied if it does not gather all the necessary conditions. Besides that, even if the reunification is granted initially it may be cancelled afterwards.
The request of family reunification may be denied, namely, in the following cases:
- When the applicant does not have aa house or means of subsistence;
- When the family member is forbidden of entering the national territory;:
- When the presence of the family member in the national territory is a threat to the public order, public security or public health.
- May I lose the acquired status of resident based on family reunification?
- Yes, besides the generic economic situations of cancelation, the resident permit issued under the right of family reunification is cancelled when the marriage, consensual union or adoption has the unique purpose to allow the interested person to enter or live in Portugal.
You may, in a party’s audience, dispute the decision of denial, challenging administrative or legally (appeal against the decision in court). The denial decision is notified and in it are the grounds of that same decision together with the right to appeal to court, as well as the deadline that you have for it.
The legal challenge must be made to administrative courts and does not stop the effects of the decision.
The legal challenge only holds the effects of a denial decision when:
- The family members are already in national territory
- The decision of denial is based upon, exclusively, in the lack of conditions of housing and means of subsistent of the applicant.
