I married a Portuguese. May I acquire Portuguese nationality?

Yes. A foreigner married with a Portuguese national may acquire Portuguese nationality upon declaration made for the effect, if all the following requirements are fulfilled:
  • Being married for more than three years;
  • Has an emotional link with the national community; 
  • Has not practiced any crime punished with prison to a maximum equal or higher than three years according to the portuguese law (ex. Homicide, offense to the physical integrity, robbery, burglary, drug traffic);
  • Cannot be a public employee of the foreign State; 
  • Didn't render non-mandatory military service to a foreign State. 
It is necessary that, in the permanence of marriage, is made a declaration of willingness of acquiring Portuguese nationality.
 
The process begins with the issuance of a declaration of willingness to be Portuguese and exhibit of documentation.
The declaration may be made by the person to whom it concerns (himself or a representative) or, if incapable, by the legal representatives which are, generally, the parents.
Once the declaration is made and gathered all the necessary elements and documents, the entity that has received it sends all the process to the Central Registration Office.
 
The Central Registration Office analyses summarily all the process within 30 days and if it comes to the conclusion that are deficiencies or lack of documents notifies the applicant to, within a deadline of 20 days, attached the missing elements.
Once the instruction is conclude, the Registrar of the Central Services verifies, within 60 days, if all the condition are gathered, in which relies the attribution of portuguese nationality and analyses if has the conditions to utter a decision.
If, from the analyses of all the elements, the Registrar concludes that the decision is negative informs the applicant so that he/ she gives response, within 30 days, to the grounds of the dismissal.After 30 days and once analysed the applicant´s response, the Registrar utter a decision authorizing or not the registration of nationality.
 
  • These declarations can be made at:
  • In the extension of the Central Registry Office, placed at the National Centre of Support to the Immigrant (CNAI) of Lisbon and Porto?;
  • At the Civil Registration Office (Areeiro, Benfica, Expo, Fontes Pereira de Melo);
  • Citizen Store - Loja do Cidadão  (Odivelas);
  • At Portuguese Consular Services
These declarations may also be made through a specific application form that must be delivered at the Central Registration Office or sent it by post.
 
The applicant has to declare that:
  • Has an emotional link to the national community;  
  • Was not condemned, with the decision res judicata, for the practice of any crime punishable with prison of a maximum equal or higher than three years  (ex. homicide, offense to the physical integrity, robbery, burglary, drug traffic);
  • Does not perfume duties of  public employee of the foreign State;
  • Didn´t render military service, non-mandatory, to a foreign State.
  • With the request o acquisition of nationality through marriage the following documents must be delivered:  
  • Model form approved (For – Mod 3)
  • Certificate of birth of the applicant, if possible integral copy and issued by copy, duly legalized and followed by translations, if written in a foreign language;
  • Certificate of birth of the Portuguese partner, of integral possible and possible issued by copy. This certificate of birth may be officially obtained by the services if the number of the birth certificate is mentioned;
  • Certificate of marriage, of integral copy possible and possible issued by copy. This certificate of marriage may be officially obtained by the services if the marriage was in Portugal;  
  • Document proving the foreigner nationality of the applicant, followed by translation, if written in a foreign language, or presentation of passport showing the holder´s nationality;
  • Certificates of Criminal Records issued by the competent services of the country of origin as well as the countries where the applicant had or has residence after 16 years, followed by translation, if written in a foreign language.  The applicant is dismissed from showing the portuguese certificate of criminal record, which is officially obtained by the Services;
  • Documents proving the nature of the public duties or non-mandatory military service rendered in a foreign State, if that is the case. The presentation of these documents take place if the applicant is in this circumstances.
  • Document proving efective link to Portuguese Comunity.

Note: The presentation of certificates is unnecessary if the correspondent act of registration are filed at the Central Registration Office.  

The acquisition of nationality through marriage or consensual is subject to mandatory registration and its effects are only produced from the date in which such registration is tiled.
