SPECIAL SITUATIONS

Article 122, paragraph 1, al a) – Minors, born in national territory to foreign parents who are holders of Residence Permit
Documents Required

The application shall be delivered personally, on a standard form signed by the applicant or by his/her legal representative, if the applicant is a minor or legally disabled, and can be submitted in any SEF directorate or regional delegation, which may send it, after proceedings and decision, to the directorate or regional delegation of the applicant’s area of residence. It shall be accompanied by:

  • Two recent, identical photographs, in colour with blank background, and easily identifiable (only for appointments at Odivelas, Aveiro or Braga SEF bureau)
  • Minor’s Birth Certificate
  • Consular Registration Certificate with photograph or a valid passport
 Notes
  • The application must be delivered in the six months following the birth registration of the minor, by either parent, with the exception of situations involving the minors’ curator
  • In cases where there is no consular representation in Portugal, the Consular Registration Certificate can be replaced by other means of proof, including an affidavit on their word of honour signed by the parents
  • Pursuant to article 124 of the Aliens Act, foreign children born in the Portuguese territory benefit from the resident status identical to the one granted to any of the parents. That is, if the parent is the holder of a permanent residence permit, a permanent resident permit with the same validity is granted to the child, and if the parent is the holder of a temporary residence permit, a temporary residence permit with the same validity is granted to the child.
